The Delhi High Court has taken a good decision to reduce air pollution in the capital city by making it clear that the cab services will have to use those cars only which have CNG Kit installed in them and would be plying on Delhi roads by using CNG.
This decision was taken by the Justice Manmohan who said that he has already passed on order against ANI technologies which is the Company who owns Ola cab by prohibiting it to use Diesel vehicle so the same should be applied to across the board.
In his statement the judge said "I cannot discriminate against them (Ola). I can't say Ola has to comply and Uber need not. You have to comply with my order on CNG. That's all."
I think this is the right decision which the court has taken as the air pollution is increased at an alarming level in the city and not just the court or law should take some actions to curb it but all people should contribute in the cause of reducing the air pollution so that everybody gets cleaner air to breathe which is very necessary at this time.
The Judge further stated that “How can people take law in their hands? You will have to behave in accordance with law," the court said, adding that "since Delhi government has come out with some scheme, why don't you (Ola and Uber) comply with it?"
Senior advocate Rajiv Nayar was representing Uber India in the court told to the court that within 6 months the company can replace the diesel vehicles with CNG cabs and they would at-least need this time because it cannot be done overnight and it needs to be done in phased manner and for the time being they will not buy new Diesel taxis.
On this above reply the Court said that Ola implemented the court decision in reasonable time period and asked Uber to be realistic and do the same in time bound manner and confirm to the Court.
Whereas Nayar told to the court that he needs to get back to the court after consulting to his client about the time frame in which they will phase out diesel taxis.
The mater is listed for Wednesday and till then Nayar will have to get back to the court after consulting Uber Company about the time in which the company could remove the taxis from the road which are Diesel.
The court took this decision over the PIL filed by the Association of Radio Taxi, which was represented by a senior lawyer Nidesh Gupta who asked in the PIL to uphold a ban on diesel which provides point to point service in the city as it was happening in the case Ola and other app based taxis were violating this order.
Earlier the Court backed the Delhi Government’s decision which said that tourist taxis with All India Permit cannot in the city as city cabs.

The High Court ordered on 29th July and 11th August which uphold the ban on diesel taxis but the app based taxi services were still operating here as claimed by the Association.
